Screenshots alone may be challenged. For higher-value matters, consider evidence-preservation methods appropriate to the likely forum, including notarization or a reliable electronic evidence service, and document the chain of custody for physical samples.
Choose the clearest right for the specific listing. A trademark may address the sign used on goods or the store page; copyright may address copied photographs, text, or artwork; a design patent may address product appearance; an invention or utility model requires a technical comparison. Mixing every right into one unfocused complaint can slow review.
Confirm that the right is valid, owned by the complainant, and covers the relevant goods or conduct. If an agent files, the authorization chain should be complete.
Under China's e-commerce framework, a notice generally identifies the rights holder, the protected right, the exact goods or services complained of, initial evidence of infringement, and a written guarantee of authenticity. The platform may forward a seller's non-infringement statement. If the rights holder does not notify the platform within the applicable period that an administrative complaint or court action has been filed, the platform may end the measure. The escalation decision should therefore be made before the first notice, especially for sellers likely to contest.
Avoid overclaiming. A knowingly false or malicious notice can create liability. Separate clear counterfeit cases from technically uncertain patent or fair-use questions.
Repeated takedowns do not solve a source-level problem. Consolidate seller identities, payment and logistics clues, common images, contact details, and purchased samples to identify related operators. The evidence can support platform-wide action, administrative complaints, civil proceedings, customs measures, or criminal referral where the legal threshold and facts justify it.
