WHY REGISTER IF COPYRIGHT IS AUTOMATIC?

Chinese copyright protection does not generally depend on registration. Registration remains useful because software is intangible and changes quickly. A certificate creates a standardized public record of the software name, version, applicant, completion information, and other filed particulars, which can simplify platform complaints, financing, licensing, procurement, and litigation preparation.

Treat the certificate as one piece of an evidence system. Source-control history, design documents, development records, release packages, contracts, and dated communications may be more important when authorship or copying is contested.

CLEAR OWNERSHIP BEFORE FILING

Identify who wrote each material part and under what relationship. Review employment terms, founder contributions, commissioned development agreements, university collaboration, group-company work, acquired code, and outsourced modules. If the applicant relies on an assignment or succession, prepare the chain of title before submitting the application.

Open-source and third-party components require separate analysis. Their presence does not automatically prevent registration, but the applicant should not claim ownership of code it does not own and must continue to comply with applicable licence terms.

PREPARE CONSISTENT MATERIALS

The application typically requires identity or entity documents, the prescribed form, identification materials for the program and documentation, and ownership evidence where relevant. The software name, version, completion date, publication status, developer information, and deposit materials must describe the same work.

Decide what source code and documentation can be deposited without exposing unnecessary confidential information. Use the permitted deposit arrangements where appropriate, but keep a complete internal evidence copy under controlled access.

KNOW WHAT THE CERTIFICATE DOES NOT DO

Registration is not a technical examination comparable to an invention patent. It does not give a monopoly over ideas, functions, algorithms in the abstract, or independently created code. It also does not cure a defective contractor agreement or prove that every deposited line is original.

For products with technical inventions, interface designs, brands, data assets, and confidential models, software registration should sit inside a broader patent, trademark, copyright, contract, and trade-secret plan.

MAINTAIN THE EVIDENCE AFTER REGISTRATION

Version releases, major rewrites, ownership changes, and licences can make an old certificate an incomplete picture. Maintain a version map that connects registrations to repositories, release dates, authors, and commercial products. When enforcing, compare the protected expression with the accused code or product rather than relying on the certificate alone.
